No contexto das políticas de salvaguarda dos direitos humanos, que obrigam os Estados
da União Europeia, esta dissertação procurou investigar como esta organização
supranacional lida com a questão dos refugiados e de como faz a sua gestão em termos
macropolíticos e jurídicos. Nesse sentido, analisa-se o conceito de refugiado em face do
que estabelecem os instrumentos de direito internacional e o direito da União Europeia,
assim como a política europeia em matéria de asilo e a sua evolução ao longo do tempo.
Considera-se ainda o impacto político, económico e social, não só da chegada de
refugiados ao continente europeu, mas do reconhecimento dos direitos dos refugiados
nas opiniões públicas e na realidade dos Estados-Membros da União Europeia. Além
disso, tendo em conta a chamada “crise dos refugiados” (2015), procura determinar-se
em que medida se justifica uma redefinição dos conceitos e políticas existentes,
sobretudo se considerarmos os muitos estereótipos em torno do que é ser refugiado e o
modo como estes condicionam as comunidades políticas nacionais e os decisores
políticos.
In the context of human rights, this thesis aimed to investigate how the European Union deals with the refugee issue and how it manages it in macro-political and legal terms. In this sense, an analysis of the concept of refugee was made in light of international law and European Union law instruments, as well as the European asylum policy and its evolution over time. Also considered was the political, economic, and social impact of the refugee law on public opinion and on the Member States of the European Union. Furthermore, because of the so-called “refugee crisis” (2015), this thesis sought to determine the relevance of a redefinition of existing concepts and policies, especially in view of the many stereotypes around what it means to be a refugee and the way these condition national political communities and decision makers.
