O Mercado de seguros Não vida assume uma posição de extrema importância na área
seguradora pela sua diversidade e especificidade de ramos e ainda pelo seu volume de
negócios. Constitui um ramo de seguros em expansão e assume uma importância primordial
na proteção dos clientes particulares e empresas na ocorrência de um infortúnio.
Com o Tratado da Comunidade Europeia inicia-se o designado Mercado de serviços
estabelecido através de etapas cujas prerrogativas no ramo de seguros Não vida foram
concretizadas sob forma de Diretivas e transpostas para o Direito Interno, com vista não só ao
desenvolvimento do Mercado Segurador, mas também à proteção ao cliente e estabilidade dos
mercados financeiros.
Nessa medida a harmonização legislativa e os planos de solvência assumem um papel
de elevada importância na concretização sustentável destes mercados.
Através das Diretivas 73/239/CEE; 73/240/CEE; 88/357/CEE e 92/49/CEE, pode analisar-se a
forma como se encontram estabelecidas as prerrogativas de acesso ao exercício da atividade
seguradora do ramo Não vida e ainda da aplicação do Direito e da supervisão prudencial.
Sendo o objetivo desta Dissertação o estudo do Mercado de seguros Não vida face ao
Direito de Estabelecimento e Livre Prestação de Serviços na União Europeia, procedeu-se à
analise da evolução deste mercado de serviços por via das Liberdades: Estabelecimento e
Livre Prestação de Serviços com base nos dados estatísticos das Instituições Europeias
nomeadamente as formas como estas terão influenciado o mercado. Por último, o caso de
Portugal e Reino Unido, pelas suas assimetrias de mercado e diferenças na transposição das
Diretivas.
The Non-Life insurance Market takes a posítion of extreme importance in the insurance setor for its diversity and specificity of services and also by its business volume. It is a market still expanding with great importance on the protection of corporate and individual customers in case of a mishap. The insurance services market "freedoms" regulation began with the European Community Treaty. In the Non-Life business it was established through steps with prerogatives that were set up in the form of directives and transposed into domestic law, in order, not only for the development of the insurance market but also aiming for customer protection and financial market stability. Thus, the harmonization of laws and Solvency plans play a highly important role in the sustainability of these markets. Through the Directives 73/239 / EEC; 73/240 / EEC, 88/357 / EEC and 92/49 / EEC, one can analyze how the companies get access to the Non-Life insurance activity and the application of the law and prudential supervision. Being the aim of this dissertation the study of Non-Life insurance Market regarding the Freedom of establishment and Freedom to provide services in the EU, It was analyzed the evolution of this market services through the "Freedoms": FE and FOS on the basis of statistical data from the European institutions, namely the ways it influenced the market. Finally, the case-study of Portugal and the United Kingdom, its market asymmetries and differences in transposítion of the Directives.
