Este trabalho resulta de um diálogo com Paulo Ferreira da Cunha, Juiz Conselheiro do Supremo Tribunal de Justiça e Professor Catedrático da Faculdade de Direito do Porto, sobre o seu livro O constitucionalismo moderno, Origens e futuro (1820-2023), publicado em 2023. Procura-se perceber o pensamento do autor sobre o papel do Direito e dos juristas na construção da democracia, perante inúmeras ameaças que levam a descrer na sobrevivência do Estado de direito. O constitucionalismo português é uma experiência bem-sucedida, mas que deve ser aprofundada e cuidada. Do diálogo resultam várias pistas de leitura da realidade e de como agir perante as ameaças existentes. A extraordinária capacidade de comunicação ao autor é expressão de um tempo novo que dá mais responsabilidades aos juristas na defesa do Estado de direito e dos direitos individuais. O trabalho de Paulo Ferreira da Cunha como magistrado é exemplo e possibilidade de colocar em prática os princípios democráticos em que acredita e que durante tantos anos ensinou.
This work is the result of a dialogue with Paulo Ferreira da Cunha, Judge of the Portuguese Supreme Court of Justice and Full Professor at the Faculty of Law of Porto, about his book O constitucionalismo moderno, Origens e futuro (1820-2023), published in 2023. One seeks to understand the author’s thinking about the role of law and jurists in the construction of democracy, in the face of numerous threats that lead to disbelief in the survival of the rule of law. Portuguese constitutionalism is a successful experience, but it must be deepened and correctly understood. The dialogue results in several clues for reading reality and how to act in the face of existing threats. The author’s extraordinary ability to communicate is an expression of a new era that gives more responsibilities to jurists in defending the rule of law and individual rights. Paulo Ferreira da Cunha’s work as a magistrate is an example and possibility of putting into practice the democratic principles in which he believes and which he taught for so many years.
