Abstract(s)
Este trabalho tem por objecto os conflitos e a violĂȘncia interpessoal nos concelhos portugueses no sĂ©culo XV.
Pretendemos saber quais sĂŁo os tipos de crimes e de delinquĂȘncia mais frequentes, as circunstĂąncias em que acontecem os delitos, a forma como o poder judicial atua, as penas aplicadas, a tipologia dos crimes que leva os acusados a apelarem com vista Ă obtenção do PerdĂŁo RĂ©gio; esta prerrogativa exclusiva do monarca contribuĂa para que o soberano visse a sua imagem e a origem divina do seu poder reforçados e elevados perante todos os seus sĂșbditos, que dele esperavam a piedade, o perdĂŁo, a justiça e nĂŁo apenas punição.
Procuramos, também, destacar a importùncia do controle do poder judicial punitivo pelo soberano, porque consideramos que foi um dos elementos adjuvantes, que contribuiu para o reforço do poder régio, propiciando a subordinação dos privilegiados às determinaçÔes emanadas pelo monarca e a manutenção da paz e da ordem.
The current research aims to study the conflict and interpersonal violence in the Portuguese territorial communities in the fifteenth century. In this paper it is intended to find out the more frequent type of crime and delinquency, the circumstances in which the crimes occur, how the judicial power operates, the penalties apply, the typology of crimes which, by gravity, it is not under the territorial communities jurisdiction and takes the accused to appeal in order to obtain the Royal Pardon. This was the exclusive prerogative of the monarch that the officers of the communities did not have. This fact contributed to enhanced and high the sovereignâs own picture and the divine origin of his power before all his subjects, who hoped for his pity, forgiveness, justice and not merely punishment. It also aims to highlight the importance of controlling the judiciary punishment by the sovereign, because we believe that it was one of the adjuvants, which contributed to the strengthening of the royal power, providing the subordination of the privileged to determinations emanating by the monarch and peacekeeping and order.
