dc.description.abstractO objetivo deste trabalho é verificar em que medida a jurisprudência permitiu alargar a proteção constitucional às novas formas de família, corroborando com a análises de decisões jurisprudenciais com o mesmo objeto, a fim de verificar se há proximidade ou distanciamento do texto constitucional. A metodologia adotada foi a pesquisa qualitativa, que se socorreu da análise documental. Para realização do estudo foram analisadas fontes documentais: livros, e-books, artigos, dissertações e teses. Foram incluídos nas análises fontes doutrinárias brasileiras no âmbito do Direito de Família e também foram analisados conteúdos jurisprudenciais que se correlacionavam com o objeto de estudo desta dissertação. Os resultados do estudo evidenciaram que o Direito deveria acompanhar a modificação dos costumes tradicionais da sociedade. Em conclusão este estudo aponta que as manifestações das decisões dos tribunais brasileiros com argumentos que reconhecem a pluralidade de modelos familiares possibilitaram a construir um regime jurídico aplicável à estes modelos de famílias pela via jurisprudencial. Os resultados do estudo evidenciam que as decisões dos tribunais brasileiros reconhecem a pluralidade de modelos familiares e que foi construído pela via jurisprudencial um regime jurídico de proteção a estas famílias. Tais decisões acarretam implicações para o tecido social, uma vez que as pessoas inseridas nestas novas formações familiares podem ter seus direitos tutelados, podem se sentir inclusas socialmente e também se pode gerar legislações mais atuais que atendam às demandas da sociedade.pt_PT
dc.description.abstractThe objective of this work is to verify to what extent jurisprudence allowed extending‘ protection to new forms of family, corroborating the analysis of jurisprudential decisions, with the same object, in order to verify if there is proximity or distance from the constitutional text. The adopted methodology was the qualitative research that used documental analysis. To carry out the study, documentary sources were analyzed: books, e-books, articles, dissertations and theses. Brazilian doctrinal sources in the scope of Family Law were included in the analyzes and jurisprudential contents that correlated with the object of study of this dissertation were also analyzed. In conclusion, of the study showed that the Law should accompany the modification of traditional society customs. In conclusion, this study points out that the manifestations of Brazilian court decisions with arguments that recognize the plurality of family models made it possible to build a legal regime applicable to these family models through jurisprudence. The results of the study confirms that the decisions of Brazilian Courts recognize the plurality of family models and that a legal regime for the protection of these families was built through jurisprudence. Such decisions have implications for the social fabric, since people inserted in these new family formations can have their rights protected, can feel socially included and can also generate more current legislation that meets the demands of society.pt_PT
