| dc.description.abstract | Para fazer face à crise migratória a União Europeia implementou um conjunto de medidas nas suas fronteiras externas, uma dessas medidas é a Guarda Europeia de Fronteiras e Costeira da Agência Europeia da Guarda de Fronteiras e Costeira. O Pessoal Estatutário (categoria 1), do Corpo Permanente, são a sua face mais visível pois são elementos contratados diretamente pela Frontex e que são destacados nos diversos Estados-Membros envergando o uniforme dessa mesma Agência Europeia. Esta medida constitui algo revolucionário pois o Pessoal Estatutário é a primeira força uniformizada e armada pertencente à União Europeia e não individualmente a um dos seus Estados-Membros. A presente dissertação tem como objetivo analisar o papel do pessoal estatutário e do Corpo Permanente da Guarda Europeia de Fronteiras e Costeira como resposta da União Europeia ao desafio migratório, com foco na segurança das fronteiras externas da UE. A atuação e poderes dessa força levanta questões sobre o equilíbrio entre a segurança coletiva e o controlo nacional das fronteiras. A dissertação procura compreender como esta Guarda impacta a soberania nacional e a integração supranacional da União Europeia, com particular ênfase aos desafios impostos pela crise migratória. Assim, recorreu-se a uma estratégia de investigação predominantemente qualitativa, assente na revisão de literatura e análise da evolução dos normativos legais, mormente o Regulamento (UE) 2019/1896 do Parlamento Europeu e do Conselho, de 13 de novembro de 2019, tendo este trabalho por objetivo apresentar de forma sistematizada, sob o ponto de vista estrutural e operacional, as implicações do Pessoal Estatutário no Corpo Permanente, procedendo-se à análise dos elementos caracterizadores dessa força, nos Estados-Membros e no desenvolvimento da própria União Europeia, a qual aproveita a crise migratória para dar mais um passo firme na sua afirmação perante as soberanias dos Estados-Membros. | por |
| dc.description.abstract | To address the migration crisis, the European Union implemented a set of measures at its external borders, one of these measures is the European Border and Coast Guard of the European Border and Coast Guard Agency. The Statutory Staff (category 1), of the Standing Corps, are its most visible face as they are elements hired directly by Frontex and who are deployed in the various member states wearing the uniform of the European Agency. This measure is something revolutionary as the Statutory Personnel are the first uniformed force belonging to the European Union and not to one of its Member States. This dissertation aims to analyze the role of statutory staff of the Standing Corps of the European Border and Coast Guard on the European Union's response to the migration crisis, with a focus on the security of EU's external borders. The actions and powers of this guard raise questions about the balance between collective security and national border control. The dissertation seeks to understand how they impact national sovereignty and the supranational integration of the European Union, with particular emphasis on the challenges posed by the migration crisis. Thus, a predominantly qualitative research strategy was used, based on a literature review and analysis of the evolution of legal regulations, particularly Regulation (EU) 2019/1896 of the European Parliament and of the Council of 13 November 2019. This work aims to present in a systematic way, from a structural and operational point of view, the implications of statutory staff in the permanent corps, proceeding to the analysis of the elements that characterize this guard, in the Member States and in the development of the European Union itself, which is taking advantage of the migration crisis to take another firm step in its affirmation over the sovereignties of the Member States. | eng |
