- Four decades of changing health systems in Southern Europe: a comparative analysis centered on the Portuguese casePublication . Jacquinet, Marc; Curado, Henrique; Gomes, Paulo Sérgio Machado Veloso; Caetano, João RelvãoHealthcare systems have undergone a wide and deep transformation that is only partly reflected in the growth of the per capita spending relative to GDP. Much more transformations are to be explained. Southern European countries are usually considered as a relatively homogeneous group with similar social trends in their health care system. Is it really so and to what extent? Are their more than three or four European models and are European societies – with regard to health policies and systems – converging? What are the specificities of Southern European countries? Our comparative analysis encompasses European countries from the EU and some other countries of the OECD. The data explored are the Health statistics from the OECD and country analysis and data. The Portuguese case serves as a yardstick to get a point of reference. Policy measures and trends will be compared. The results can be summarized at two or three levels: (1) the changes in demography with ageing population all over Europe, (2) the reorientations of health policies and (3) the new social practices around those health national systems. Some specificities of the different counties or group of countries are to be highlighted. The picture is one of complex change: neither a simple convergence nor clear divergences.

Furthermore, the information that can be disclosed about an individual can also be used, intentionally or unintentionally, for economic and social discrimination, especially in insurance, employment, attribution of bank credits and other access issues (Rose & Novas, 2005). Alongside the scientific revolution, the European understanding and acceptance of biotechnology evolved. Data protection is an important aspect of medical data and a major condition for the safeguarding of fundamental rights and freedoms of individuals, especially privacy. However, the development of these important safeguards still requires the consideration of many key questions about the meaning of privacy in relation to genetic information and about effective protection of legitimate rights (Taylor & Townend, 2010. Several studies have been devoted to the ethical, regulatory and social challenges associated with biobanks, particularly in relation to consent and privacy.

Jacquinet, Marc; Curado, Henrique; Nobre, Ângela Lacerda; Bussotti, LucaA primeira questão desta comunicação é a do risco de acesso à informação médica de pacientes em plataformas digitais, nomeadamente às que processam registos de saúde de pacientes e doentes, sejam em consultórios médicos, clínicas, hospitais, farmácias, sistemas públicos ou privados de saúde, entidades empregadoras e companhias de seguros ou mesmo bancos. O risco deve ser entendido em termos latos, incluindo riscos financeiros, jurídicos, sociais e pessoais. Além desta abrangência de domínios da vida quotidiana, deve ser tomado em conta os riscos futuros em termos de fenómenos emergentes. Um enfoque será dado aos aspetos jurídicos e sociais, para lá das abordagens tradicionais de economia. É importante salientar que a questão da saúde, da ciência e da técnica na saúde abrange mais do que os aspetos económicos e financeiros. Estes aspetos podem ser relacionados com o conceito de risco e permitem sublinhar quem suporta ou partilha os riscos e as suas consequências. Depois de definir os conceitos utilizados, em termos de risco, plataforma, sistemas de informação, direito à privacidade da informação, segurança da informação pessoal, registo eletrónico de saúde, entre outros, passamos a desenvolver as várias dimensões do risco e como se relaciona com a informação do paciente. A seguir, o presente texto tomará alguns exemplos ou casos ilustrativos da prática no setor da saúde em Portugal e na Europa. Uma breve consideração sobre as doenças raras será feito. Numa terceira parte, vai se analisar os desafios futuros em termos de expansão dos sistemas tecnológicos e de sistemas de informação e como isto se relaciona com a gestão dos dados clínicos e o direito à privacidade e a proteção da dignidade dos indivíduos.

- Opportunities and challenges for electronic health record: concepts, costs, benefits, and regulationPublication . Jacquinet, Marc; Curado, HenriqueIn this section, after a brief history, the issue of definition and several dimensions of electronic health records will be tackled. If the first known medical records can be traced to Hippocrates and the goals he attributed to these records were to describe accurately the course of a disease and gives a probable cause of it; the electronic dimension of these records can be traced back to the 1960s in some hospitals that started a more systematic recording and use of patients’ data by services and doctors. But it is still more recently, in the 1990s, with the ever wider use of internet and online databases that the electronic health record emerged as a new tool in the public health systems of OECD countries. There are different definitions of electronic health record, depending on the theoretical perspective or even the main user or the political point of departure taken in the implementation process. Even so, here and in the literature on the subject, the electronic health record has become and is the generic term. Other focuses like electronic medical record (or registry) and the electronic patient record are based on either the perspective of the user or the subject of the information. All these expressions are part of the general move from traditional management of health and medicine to electronic health and medicine or e-health (written more and more frequently ehealth as its use spreads across countries and within national health and health care systems). To settle the record straight, the definition of the Electronic Health Record that can serve as a consensus for the current exposition as well as a starting point for further research is the one given by the International Standards Organization

- Management of tacit knowledge and the issue of empowerment of patients and stakeholders in the health care sectorPublication . Jacquinet, Marc; Nobre, Ângela Lacerda; Curado, Henrique; Martins, António Eduardo Pais Falcão Barbosa; Arraya, Marco; Sousa, Maria; Pimenta, RuiThere is a growing literature on health and health care dedicated to empowerment of patients; but there is still a gap in the literature to conceptualize knowledge, to extend the discussion of the empowerment of the patients to the stakeholders. The discussion is at the level of managerial processes of empowerment and knowledge management related to health care. The present chapter starts with a review on empowerment, especially focused on the health sector. The following sections will develop a critical analysis of empowerment, mainly around the concept of tacit knowledge (Polanyi) and knowledge management. One key variable is the proximity of the actors involved in the empowerment process. This key variable is very much related to the tacitness issue of knowledge production and flows. The chapter extends the discussion of the empowerment of the patients to that of the stakeholders and the general debate about health literacy. A model is briefly described for the purpose of illustrating the learning process in a knowledge management implemented in health care.
- A importância da segurança e privacidade da informação: análise do estudo elaborado pelo Estado para a implementação do registo de saúde electrónicoPublication . Gomes, Paulo; Jacquinet, Marc; Curado, HenriqueO registo de saúde electrónico, que faz parte das chamadas medidas de saúde electrónica ou e-saúde (e-health), apresenta-se como uma das ferramentas da reforma do sistema de saúde em que Portugal tem vindo a apostar. Esta medida levanta uma série de questões importante no que diz respeito à regulação e organização do sistema de saúde, a princípios de direito, nomeadamente a volta da noção de privacidade, e à segurança da informação de utentes ou doentes. Depois de dar um enquadramento geral do problema em apreço e da evolução recente do sector, neste trabalho, trataremos das questões de regulação, de direito e de segurança que se vislumbram com a implementação de um registo de saúde electrónico.
