A defesa do ambiente e da sustentabilidade do desenvolvimento requer formas inovadoras
de participação dos cidadãos, mas também o uso dos mecanismos convencionais de
comunicação com os poderes públicos. O direito de petição constitui um instrumento de
garantia de outros direitos e de participação política - com raízes seculares, tem sido alvo de
formas de adaptação a uma participação mais exigente dos cidadãos. O presente estudo
relaciona o exercício do direito de petição com os temas ambientais, dedicando-se à análise
das petições que incidem sobre matérias de ambiente (e respetiva tramitação), enviadas à
Assembleia da República entre 1976 e 2015 (da I à XII legislatura). Dá-se a conhecer as
características destas petições, analisando aspetos como a sua quantidade, os seus conteúdos
e os seus subscritores, e também se explora a reação do Parlamento, quer no âmbito dos
modos, quer dos tempos de resposta, que são os fatores recorrentemente apontados como
desincentivadores do ato de peticionar. Verifica-se que a realidade das primeiras legislaturas
apresenta diferenças em relação às últimas, com o inegável contributo da regulamentação do
exercício do direito de petição e do ajustamento de práticas parlamentares, mas também num
quadro em que a consciência ambiental ganhou outra expressão.
The defense of the environment and of sustainable development requires new forms of citizen participation, as well as the use of traditional methods to communicate with public power. The right of petition is a way to ensure other rights and political participation - in spite of having century roots, it has been adapted to a more demanding citizen participation. This study relates the use of the right of petition with environmental issues, by analyzing the petitions that focus on environmental matters (including their processes), addressed do the portuguese parliament between 1976 and 2015 (I to XII legislature). We make those petitions’ characteristics known, by analyzing some aspects such as quantity, contents and type of petitioners, and we also refer to the parliament’s reaction concerning the way and time expended do answer – these last ones are frequently pointed out as discouraging the use of petitions. We found differences between the first legislatures and the last ones, mostly due to the regulation of the right of petition and the parliamentary practices’ adjustments, and considering a different environmental consciousness.
