O uso de novas tecnologias, especialmente a Inteligência Artificial, exige o processamento de dados pessoais, e essas questões têm sido abordadas por leis de proteção de dados, particularmente quando envolvem tecnologias de reconhecimento biométrico e tomada de decisões automatizadas. A Lei Geral de Proteção de Dados no Brasil (Lei nº 13.709/2018 - LGPD) fornece um marco precaucional a ser analisado em relação aos riscos apresentados aos usuários, titulares de dados, em aplicações que envolvem Inteligência Artificial. Esta pesquisa fornece uma base sólida para o uso de sistemas de inteligência artificial, com foco no reconhecimento biométrico, priorizando ética e legalidade, destacando as melhores práticas e garantindo conformidade com os princípios da LGPD. A contribuição da presente pesquisa está no avanço do conhecimento sobre os riscos biométricos e no fornecimento de orientações práticas para as organizações que buscam adotar essa tecnologia de forma responsável.
The use of new technologies, especially Artificial Intelligence, requires the processing of personal data, and these issues have been addressed by data protection laws, particularly when involving biometric recognition technologies and automated decision-making. The General Data Protection Law in Brazil (Law No. 13,709/2018 - LGPD) provides a precautionary framework to be analyzed concerning the risks posed to users, data subjects, within applications involving Artificial Intelligence. This research provides a solid foundation for the use of artificial intelligence systems, with a focus on biometric recognition, prioritizing ethics and legality, highlighting best practices, and ensuring compliance with LGPD principles. The contribution of the present research is in the advancing knowledge on biometric risks and practical guidance for organizations seeking to adopt this technology responsibly.
