Trata-se de pesquisa e análise de sentenças e acórdãos proferidos por Tribunais
Brasileiros no período dos anos de 2006 a 2017, em processos penais que apuram crimes
sexuais, de violência doméstica e familiar e de feminicídio (praticados com violência de
gênero contra mulher), à luz dos Estudos de Gênero e uma possível Teoria Feminista do
Direito, com o objetivo de se verificar como a jurisprudência vem tratando da defesa
dos direitos das mulheres vítimas de crimes com motivações de gênero no Brasil,
principalmente após o nítido avanço da legislação especializada na temática, ocorrido
na última década. A partir de delimitado conceito legal de violência de gênero e de
histórico legislativo hábil a contextualizar os tipos penais escolhidos (Lei 11.340, de 7 de
agosto de 2006, Título V do Código Penal Brasileiro e Lei 13.104, de 10 de março de
2015), buscaram-se acórdãos e sentenças disponíveis na internet ou no próprio sistema
de controle processual dos Tribunais e que, para além uma mera discussão jurídica,
também evidenciaram posicionamentos possivelmente influenciados por questões de
gênero. As principais conclusões observadas referem-se à ainda presente resistência por
parte dos operadores do Direito de aplicarem de forma efetiva a legislação especializada
no combate aos crimes de violência de gênero contra as mulheres, ao tratamento
discriminatório para com a violência de gênero por parte do Sistema de Justiça e à
interpretação da lei de forma desfavorável à vítima, a qual, inclusive, ainda é
culpabilizada e tem seu comportamento avaliado como fundamento para eventual
absolvição ou atenuação da pena de agentes delituosos.
Research and analysis of judgements and rulings handed down by Brazilian Courts from 2006 to 2017, in criminal cases that investigate sexual crimes, domestic and family violence, and feminicide (practiced with violence against women) in the light of Gender Studies and a possible Feminist Theory of Law, with the objective of verifying how the jurisprudence has been dealing with the defense of the rights of women victims of crimes with gender motivations in Brazil, especially after the clear progress of the specialized legislation in the last decade. Based on the delimited legal concept of gender violence and a legislative history that is capable of contextualizing the chosen criminal types (Law 11.340 of August 7, 2006, Title V of the Brazilian Penal Code and Law 13.104 of March 10, 2015), judgements and rulings were available on the Internet or in the Courts' own system of procedural control and, in addition to a mere legal discussion, also highlighted positions possibly influenced by gender issues. The main findings observed refer to the still present resistance by the legal operators to effectively apply the specialized legislation to combat crimes of gender violence against women, the discriminatory treatment of gender violence by the System of Justice and the interpretation of the law in an unfavorable way to the victim, who is even still blamed and has its behavior evaluated as grounds for possible acquittal or mitigation of the penalties of criminal agents.
