| dc.description.abstract | Esta dissertação analisa a ação externa da União Europeia (UE) na Questão das Malvinas/Falklands, com atenção na evolução do seu posicionamento político‑diplomático e no enquadramento jurídico relevante antes e depois do Brexit. Adota-se uma metodologia qualitativa de estudo de caso baseada em análise documental de três conjuntos de fontes: (i) resoluções e documentos das Nações Unidas sobre a disputa, incluindo o trabalho do Comité Especial de Descolonização; (ii) instrumentos e posições institucionais europeias, distinguindo-se a atuação da CEE em 1982 e o quadro pós‑Tratado de Lisboa; e (iii) o Acordo de Comércio e Cooperação EU-Reino Unido e a respetiva cláusula de âmbito territorial. A investigação mostra que a intervenção europeia se manifesta sobretudo por instrumentos económico‑comerciais e por linguagem diplomática prudente, mais do que por uma tomada de posição substantiva sobre soberania. O precedente de 1982 evidencia a capacidade de a então CEE traduzir solidariedade política em medidas restritivas. Após o Brexit, a exclusão das Falkland Islands e dependências do âmbito territorial do TCA confirma uma reconfiguração institucional com impacto na “camada territorial” do relacionamento UE–Reino Unido, com efeitos para a coerência e a projeção externa europeias neste dossiê. | por |
| dc.description.abstract | This dissertation analyzes the external action of the European Union (EU) in the Falklands/Malvinas/Falklands Issue, with attention to the evolution of its political-diplomatic positioning and the relevant legal framework before and after Brexit. A qualitative case study methodology is adopted based on documentary analysis of three sets of sources: (i) United Nations resolutions and documents on the dispute, including the work of the Special Committee on Decolonization; (ii) European instruments and institutional positions, distinguishing between the performance of the EEC in 1982 and the post-Lisbon Treaty framework; and (iii) the EU-UK Trade and Cooperation Agreement and its territorial scope clause. Research shows that European intervention is manifested mainly by economic and commercial instruments and prudent diplomatic language, rather than by taking a substantive position on sovereignty. The precedent of 1982 shows the capacity of the then EEC to translate political solidarity into restrictive measures. After Brexit, the exclusion of the Falkland Islands and dependencies from the territorial scope of the ATT confirms an institutional reconfiguration with an impact on the "territorial layer" of the EU-UK relationship, with effects on European coherence and external projection in this dossier. | eng |
