A presente investigação procede a uma incursão pela História, Antropologia, Filosofia,
Política e Direito, a fim de discutir a importância dos Direitos Humanos como gramática e
fundamento do Estado de Direito e da Democracia na Europa, assim como também no
mundo com o qual a Europa se relaciona. Dando-se especial atenção ao que se passa na
União Europeia, procura definir-se uma fórmula que possibilite responder ao objetivo
político e cultural de uma Europa unida, em torno de valores e princípios, permitindo-lhe
dar respostas eficazes aos problemas complexos que enfrenta e que fazem as pessoas, mais
do que crer, descrer da viabilidade do projeto de construção europeia. Nesta investigação,
discutem-se as diferentes conceções de Direitos Humanos, dentro e fora da Europa (em
particular da União Europeia) e da civilização ocidental, dando-se especial atenção à
discussão sobre o caráter universal ou particular dos Direitos Humanos, assim como aos
grandes desafios colocados pelo multiculturalismo e perspetivas afins ou concorrentes. O
ponto central da investigação passa por perceber que tipo de respostas podem ser dadas ao
desejo de construção de uma Europa unida, próspera e solidária.
The present investigation makes an incursion into History, Anthropology, Philosophy, Politics and Law, in order to discuss the importance of Human Rights as a grammar and foundation of the Rule of Law and Democracy in Europe, as well as in the world with which Europe is related. Paying special attention to what is happening in the European Union, it seeks to define a formula that makes it possible to respond to the political and cultural objective of a united Europe, around values and principles, allowing it to give effective answers to the complex problems it faces and that make people, more than believe, disbelieve the viability of the European construction project. In this investigation, the different conceptions of Human Rights are discussed, inside and outside Europe (in particular the European Union) and Western civilization, paying special attention to the discussion about the universal or particular character of Human Rights, as well as to the major challenges posed by multiculturalism and related or competing perspectives. The central point of the investigation is to understand what kind of answers can be given to the desire to build a united, prosperous and solidary Europe.
