Tudo tem o seu momento de progresso. De forma rápida ou mais lentamente, a sabedoria humana altera-se. As forças de segurança que zelam pelo bemestar coletivo tiveram, também, o seu desenvolvimento. Verificaremos, numa breve alusão a algumas polícias europeias atuais, o seu progresso, relativamente à criminalidade ou à mera infração e ao respeito pelos direitos fundamentais. As revoluções liberais do século XVIII, de onde sobressai a Declaração dos Direitos do Homem e do Cidadão, impulsionam a sociedade para uma nova forma de ver o Homem e, em particular, o indivíduo. Os direitos humanos, em primeiro lugar, e os direitos sociais e económicos depois, vieram proporcionar ao trabalhador privilégios para melhor administrar a sua vida privada, já não sujeito à vontade arbitrária do empregador. Neste sentido, o direito à negociação coletiva e, posteriormente, o direito à greve tornaram-se nas melhores armas do trabalhador na prossecução de melhores condições de vida, a que se juntaram, entre outros, os direitos de ordem social, como o direito à proteção da saúde, da maternidade/parentalidade, da proteção social em caso de desemprego. Os polícias, embora não seja percecionado por todos os políticos ou juristas, são trabalhadores. São funcionários públicos porque o seu vínculo profissional encontra-se sob a alçada do poder central do Estado. Têm deveres, mas também têm direitos. Se os deveres, para com a segurança da população e dos seus bens, são cumpridos, não se compreende qual o motivo por que lhes continuam a serem negados certos direitos que a todos os trabalhadores são concedidos. O direito à greve é o maior dos exemplos. É óbvio que os polícias não poderão deixar de exercer as suas funções profissionais, mas também é verdade que devem ter direito a mostrarem a sua indignação quando os seus objetivos de melhores condições de vida e de trabalho são defraudados na negociação coletiva com a administração central. Se usufruem da maior parte dos direitos atribuídos aos restantes funcionários públicos, mostraremos por que devem ver o direito à greve ser uma prerrogativa atual. Humanity evolves. Human rights increase. The Right changes. Human culture develops. Everything has its moment of progress. Quickly or slowly, human wisdom changes. The security forces that care for the collective well-being have also had their development. We will look briefly at some of the current European police, their progress in relation to crime or mere infringement and respect for fundamental rights. The liberal revolutions of the eighteenth century, from which the Declaration of the Rights of Man and the Citizen stand out, impel society towards a new way of seeing Man and, in particular, the individual. First, human rights and social and economic rights have come to provide the worker with privileges to better manage his private life, no longer subject to the arbitrary will of the employer. In this sense, the right to collective bargaining and, subsequently, the right to strike became the best weapons of the worker in the pursuit of better living conditions, to which, among others, social rights, such as the right to protection of health, maternity/parenthood, social protection in case of unemployment. The police, although not fully understood, are workers. They are civil servants because their professional ties lie under the authority of the central State. They have duties, but they also have rights. If the duties to the safety of the population and their property are fulfilled, it is not understood why they continue to be denied certain rights granted to all workers. The right to strike is the greatest of examples. It is obvious that the police cannot fail to carry out their professional duties, but it is also true that they should be entitled to show their indignation when their objectives of better living and working conditions are defrauded in collective bargaining with the central administration.
