Em Portugal este dever é titulado pelos pais e exercido num quadro legal restritivo, que limita e condiciona a escolha do nome próprio. Este mecanismo de política onomástica foi desenvolvido no século XVI, num contexto de mudança social imposta por D. Manuel I, e perdura, no essencial, até aos nossos dias. A investigação incide, pois, sobre o acervo normativo que regulamenta o nome, relacionando-o com dinâmica e mudança social, tendo como referencial teórico o trabalho pioneiro de Robert L. Cooper. The right to a name is a fundamental right, well established in law and doctrine. In Portugal this ‘right-duty’ is entitled by the parents and exercised in a restricted legal framework, which limits and constrains the choice of names that can be legally given. This mechanism of onomastic policy was developed in the sixteenth century, in a context of social change, imposed by D. Manuel I, and endures, in essence, to this day. The research focuses, therefore, on the normative corpus that regulates the name, relating it to dynamics and social change, having as theoretical background the pioneering work of Robert L.
