O trabalho tem como objetivo analisar os impactos do novo Regulamento Geral de
Proteção de Dados nas relações empresariais entre Brasil e União Europeia
Dessa forma, será apresentada a Lei Geral de Proteção de Dados brasileira em conjunto
com a Constituição Federal de 1988, seus princípios e sua importância para o
desenvolvimento da proteção de dados.
Assim como, explicar a Lei Geral de Proteção de Dados no âmbito da legislação brasileira
frente ao regulamento da União Europeia, além de diferenciar a Lei Geral de Proteção de
Dados promulgada no Brasil com o Regulamento Geral de Proteção de Dados da União
Europeia.
Dessa forma a Lei Geral de Proteção de Dados (LGPD) no Brasil e Regulamento Geral de
Proteção de Dados (RGPD) da União Europeia (UE) trazem impactos positivos nas
relações comerciais.
Nesse sentido, será elucidado a proteção de dados, inclusive frente as empresas, no
contexto do Mercosul, no Brasil e na União Europeia, em Portugal e quais foram os
impactos para a legislação brasileira e Europeia e suas relações e quais as medidas foram
tomadas com esses regulamentos.
Por fim, exemplificaremos as medidas tomadas com um estudo comparativo de leis entre o
Brasil e a União Europeia, a metodologia de estudo e a revisão bibliográfica no sentido de
evidenciar os motivos que fizeram com que as novas leis fossem criadas e também para
demonstrar que as empresas e pessoas devem se adequar frente às novas regras para que
não sejam punidas e possam continuar com suas atividades.
The work aims to analyze the impacts of the new General Data Protection Regulation on
business relations between Brazil and the European Union
In this way, the Brazilian General Data Protection Law will be presented together with the
Federal Constitution of 1988, its principles and its importance for the development of
privacy protection.
As well as explaining the General Data Protection Law within the scope of Brazilian
legislation in light of the European Union regulation, in addition to differentiating the
General Data Protection Law enacted in Brazil with the General Data Protection
Regulation of the European Union .
Thus, the General Data Protection Law (LGPD) in Brazil and the General Data Protection
Regulation (GDPR) of the European Union (EU) have positive impacts on commercial
relations.
In this sense, data protection will be explained, including vis-à-vis companies, in the
context of Mercosur, in Brazil and in the European Union, in Portugal and what were the
impacts on Brazilian and European legislation and what measures were taken with these
regulations.
Finally, we will exemplify the measures taken with a comparative study of laws between
Brazil and the European Union, the study methodology and the bibliographic review in
order to highlight the reasons that caused the new laws to be created and also to
demonstrate that the companies and people must adapt to the new rules so that they are not
punished and can continue with their activities.
